Settlements

Medical errors are the third leading cause of death in the U.S. We recommend everyone be proactive in their health care to help avoid medical errors. Our blog articles, online tips, and free attorney consultations are always available. We have settled many cases for significant monetary amounts, without our clients having to relive painful and emotional situations in courtrooms.

Recent Settlements:

Pegalis Law Group obtained a $875,000 settlement for a man who had surgery performed at the incorrect level of his spine. A 24-hour delay in surgery to correct this error then led to further damage, which could be permanent.
Pegalis Law Group obtained a $750,000 settlement for an infant boy, who sustained a left-sided Erb’s palsy during his birth. The decisions made by healthcare providers to allow a vaginal delivery, as well as the obstetrician’s improper delivery maneuvers during the birth, were clear departures from good and accepted medical care.
Pegalis Law Group obtained a $7.5 million settlement for an infant girl who suffered severe, irreparable, and permanent damage to her brain and central nervous system following her birth. As a result of the hospital's negligence, the infant plaintiff will be unable to function normally or to care for any of her own needs, and will always be dependent on care givers.
Pegalis Law Group obtained a $4.25 million settlement for a client in Bronx, NY. There was an unreasonable delay in the diagnosis of the patient’s underlying cancer, and by the time she was diagnosed, the surgery–which should have been relatively simple–was extensive. The extent of this complicated surgery and the failure to properly care for this patient, post-surgery in the ICU resulted in the patient being permanently paralyzed from the neck down.
Pegalis Law Group obtained a $750,000 settlement for a newborn baby girl who was injured by her mother’s obstetrician during childbirth. As a result of the delivering doctor’s negligence, the infant suffers from the permanent effects of a right sided Erb’s Palsy, including scars, cosmetic deformities, and limited motion in her right arm and shoulder due to nerve injury in her cervical spine.
Pegalis Law Group obtained a $3.5 million settlement for the family of a late 51-year-old Bay Shore, NY resident. Following coronary artery bypass surgery, the patient had uncontrolled coughing, which led to a separation of his midline sternal incision. This resulted in his heart being forcibly ejected from his chest while he was awake, ultimately leading to his untimely death.
Pegalis Law Group obtained a $2.5 million settlement for the family of a 51-year-old husband and father, whose improper treatment for blood clots resulted in his untimely death. A powerful, clot-dissolving drug known as tPA was administered, while the patient already had an anti-coagulant called Lovenox in his system. The mixing of the two drugs caused massive bleeding in the patient's brain, ultimately leading to his death.
Pegalis Law Group recently obtained a $2 million dollar settlement for the family of a 34-year-old wife and mother. Our client underwent an exercise stress-test, which was stopped because she developed chest pain, shortness of breath and left arm pain. Due to the normal EKG results, no further testing was done for coronary artery disease. This additional testing could have prevented the untimely death of our client.
